PEC 181: uma perspectiva sobre o aborto legal e o impacto causado

The present work aims to analyze abortion in Brazil and the impact that Proposal for Amendment 181 would have on abortion considered legal in Brazil. We try to explain and critically problematize the conduct of abortion typified in the Penal Code (illegal abortion) and ma ke considerations about legal abortion, provided for in article 128 of the current Penal Code, in addition to making some considerations about PEC 181, as it was the target of considerable criticism. It is known that the issue of abortion, whether it is le galized or not, is a topic that causes disagreements, since it involves moral, ethical, religious and even health issues, among others that make the subject very complex and controversial. Although abortion is prohibited and even criminalized in Brazil, th ere are some hypotheses in which it is allowed, which are the so - called legal abortions, which add up to 2 legal hypotheses and one jurisprudential. However, there is a proposal for a constitutional amendment in progress, PEC 181, whose initial objective w as to expand labor rights, had its text amended on 11/11 // 2017 including provisions that would make the termination of pregnancy illegal even in permitted cases, today, by law.
