Child Labor in Brazil and the Disparity Between Legislation and Reality

This article aims to analyze the problem of child labor in Brazil and the disparity between legislation and reality. In summary, we want to know if child labor is allowed or prohibited in the country, and if it is allowed, it will be demonstrated what the minimum age authorized by law would be for a child or adolescent to be able to work, once they are in the process of psychological and social formation. Among the characteristics of the so-called child labor, will be specified in the body of this work, the laws until then in force that discipline the theme, as well as the peculiarities of this labor contract. It urges to emphasize that the approach of legal institutes such as the Consolidation of Labor Laws, is necessary, in order to reach an understanding of the problem under analysis, namely, child labor in Brazil. In addition to the focus on research, which is to analyze the understanding of Brazilian jurisprudence on the subject, the possibility of entering into an employment contract with minors and the requirements to be fulfilled in this contract will also be analyzed. Thus, it appears that the results are all described in the conclusion of this article, showing, with this, the judicial decisions and the pacification of the jurisprudence when the theme child labor and the requirements that must be observed in order to have or not the recognition the signing of the aforementioned employment contract under Brazilian law, even if the subject of that job is a minor. Subject to this subject of discussion in the present study.
