Indenização na ocorrência de alienação parental

The present work aims to address, at first, the evolution of the family in Brazilian law, emphasizing its importance as an affective institute and dealing with custody modalities. In a second step, the parental alienation institute will be approached, unde r the analysis of the legal and psychological problems caused to children and adolescents, with emphasis on the parental alienation syndrome. Parental alienation generally arises as a result of the litigious separation of the parents, at which point one of the parties ends up campaigning for the demoralization of the other parent, which compromises the emotional health of the child or adolescent, harming family life. The Law 12.318 / 2010 is explained, commenting on its origin and concept, demonstrating its characteristics and applicable sanctions. In addition, consideration will be given to civil liability in cases of parental alienation. Finally, the relevance of the application of indemnity in the face of acts arising from the alienator is examined.
