A responsabilidade do empregador em situações de desastres em barragens

This monograph has as object the institute of civil responsibility, its ramifications and unfolding, especially in what concerns the theory of risk and its applicability in harmful events from risky activities, among them mining. Its objective was to correlate the greatest environmental tragedy of the country that occurred in the rupture of the dam of Fundão/MG, which devastated the municipality of Mariana/MG, cities and even neighboring states as a model of practical applicability of risk theory in the civil liability of those involved. For that, a scientific study was carried out through theoretical, doctrinal and jurisprudential contributions. The results show that in events of this nature, it is mostly understood by the applicability of the theory of risk in the responsibility that is being imputed to the agents involved, a risk that is potentially inherent to the activity and that only after the mediatic spread of these tragedies that were no longer rare, some measures have been adopted by the State and competent authorities to legislate, regulate and supervise such activity, whose effective results still depend on the continuity of the use of common efforts so that new tragedies of this nature will not happen again.
