The importance of reception of the victim in criminal law

Synopsis

The theme analyzes the legal-criminal relationship related to cases of crimes against sexual dignity, using the study of victimology and criminology for better reception, recovery of the victim and the possible reintegration of the criminal into society, as well as the role of the victim in the criminal process. Cases involving sexual violence require extreme delicacy due to the nature of the possible crime, as it is of great stigma for the accused and the victim, generating an almost automatic condemnation of one of the parties without analysis of the personality of the parties, possible through the victimology that it is the study of the victim in terms of his personality, his biological, psychological and social structure, in addition to the consequences of the crime on the victim in the criminal relationship and criminology, the study of crime, the criminal and the social implications. In this way, with an analysis of the role of the victim in the crime, it generates the opportunity to apply a public policy aimed at remedying or trying to reduce the possible damage caused by the crime.
