The Psychopath´s Criminal Responsability In The Light of The Current Brazilian Legal Order

Psychopathy is a type of personality disorder characterized by disregard for social obligations or lack of empathy for others. There is still no cure for this disorder, as psychopaths do not regret or suffer from the consequences of their actions. The objective of this work is to analyze the behavior of homicidal psychopaths and verify if they are fully aware of their actions when they commit a crime. In this sense, the problem theme is to demonstrate the criminal responsibility of the homicidal psychopath in the light of Brazilian Criminal Law. For this, we sought to understand the profile of the psychopath from the perspective of psychiatry. It was also sought to carry out a study on culpability in Criminal Law, analyzing criminal liability, non-imputability and semi-imputability. Finally, the criminal responsibility of the homicidal psychopath was analyzed, in order to verify if a security measure or prison sentence is applied to him. The research method adopted was hypothetical-deductive and the type of research presented was bibliographic, using as a theoretical framework the work: Criminal Law Course – General Section by Rogério Greco. Regardless of the effectiveness of the arrest or not, especially in order to give a response to society, it is necessary that the psychopath be charged with the criminal penalty of imprisonment for his offense in order to subsequently refer him to an appropriate establishment, so that he has an effective state monitoring of a highly qualified multidisciplinary team.
