The employer's liability for work accidents at the remote workplace
Keywords:
teleworking, employer, responsibility, work accidentSynopsis
The present work aims to analyze the employer's liability for work accidents in the remote workplace, considering that the provision of services may or may not occur outside the employer's premises. The introduction of teleworking into Brazilian labor legislation occurred through the Labor Reform through Law 13,467/2017, which changed several articles of the CLT. Although remote work presents challenges in terms of ensuring the safety and health of employees, the employer may have similar responsibilities as traditional workplaces – those within the company. In this sense, it is up to the employer to ensure that employees receive guidance on health and safety when teleworking, as well as offering adequate supervision to monitor the work environment. The methodology used to unfold the work was the hypothetical-deductive method, using laws, principles and Brazilian doctrine on the topic as means of research.
