Synopsis

This work aims to analyze the criminal exclusion of the conduct of the precision shooter Sniper. The Sniper is a highly trained police officer or soldier specialized in using weapons that fire long-range shots, such as rifles, for example. Its main function is to fire neutralization shots in highly complex incidents. Thus, the Sniper, once requested to be present at the scene of the incident, will, if necessary, fire precision fire, as long as it is authorized by his hierarchical superior, who is generally the commander of the operation. Its function is to neutralize the danger that threatens public safety and restore peace. In this sense, the shooter needs a guarantee that his actions are in accordance with legal precepts, therefore, the criminal exclusion that protects the Sniper as well as his hierarchical superior will be analyzed. To this end, we will first seek to demonstrate the origin of the Sniper and the legislation pertinent to this precision shooter. Afterwards, the role of the military police Sniper and the infraction of refusal to obey in the Military Penal Code will be noted. Next, the Sniper's illegality exclusions will be highlighted. Finally, the exclusion of culpability for the neutralization shot will be demonstrated. The methodology used in the preparation of the work was theoretical-bibliographical, developed through doctrines and electronic legal articles, also using documentary research, through Brazilian legislation pertinent to the topic.
