Overcrowding in the Brazilian prison system: a chronic problem of violation of fundamental rights

This work aims to discuss the overcrowding of the Brazilian prison system, which has become a chronic problem of violating the fundamental rights of those under the guardianship of the State. To achieve this objective, the work covered the general aspects of prison and the prison system, presenting an x-ray of the prison crisis in Brazil. With this, it sought to demonstrate, based on statistical data, how the overcrowding of the Brazilian prison system has become a chronic problem of violation of the fundamental rights of prisoners, in a constant unconstitutional state of affairs. Finally, it was about the feasibility of privatizing penitentiaries as one of the solutions to the serious crisis in the Brazilian prison system. The methodology used was bibliographical research, through which books and articles were used to study the guarantees of human rights of inmates in the Brazilian prison system, which was also developed with the help of doctrines, jurisprudence, concrete cases and statistics already published. The theme was developed based on a literature review, seeking to bring a solution to the problem of prison overcrowding and the violation of prisoner’s fundamental rights.
