The protection of fauna and flora: and criminal responsibility in environmental law

This article has as its subject environmental law with emphasis on the protection of fauna and flora, having as its theme the problem the civil and criminal liability of the Legal Entity that violates environmental laws in Brazil. A subject that is gaining a lot of space in society, but that still needs many "steps"" to improve. First, the concept of environmental law and its characteristics will be addressed, along with its historical aspect. Then we sought to make an analysis of environmental legislation that is one of the most important things in this work, because the problem that is intended to understand is the lack of applicability and ineffectiveness of environmental laws. Finally, it will be demonstrated the civil and criminal liability of the Legal Entity that violates the current legislation, as well as seek to analyze the Brumadinho case that gained worldwide repercussion due to the tragedy that occurred recently and that caused the loss of human lives and environmental degradation. Illegal deforestation was also analyzed in the Serra do Curral caused by a Mining Company that is an affront to environmental law, because this is a reserve area. An exploratory research was carried out where information on environmental law was raised.
