Civil liability for affective abandonment and its consequences

The present article aims to observe how affective abandonment and seen and addressed not only in Brazilian law itself, but also by society and to investigate the feasibility of compensation in the face of affective abandonment where there is the possibility of the child seeking judicial reparation and obtaining a possible reparation for the moral and psychic damage caused by the absence of parents during their development. Therefore, an analysis of a question in which it pleads to the rights and duties imposed in Brazilian legislation on parents to their children. It is the duty of the family to care, teach and love. There will also be a search for questioning about the effectiveness of the duty of care and for the child/adolescent if loving is an obligation, the criteria required to live up to the reparation of the damage caused, and the society's view to duty and obligation, concluding that Brazilian law and the judiciary ensure reparation for moral damages as the civil liability of parents.
