Birdnesting: The New Model Of Shared Custody

The general objective of this scientific article is to discuss birdnesting, reporting the general aspects, applicability, advantages and disadvantages, how parents and children behave in the face of this new type of custody. Demonstrate the types of custody that exist in the Brazilian legal system and outside it. Thus, the following question is discussed: Would the new shared custody model Birdnesting, also known as nesting, be applicable in Brazil? And what are the possible advantages and disadvantages of this new modality? To carry out this article, a qualitative approach was used, through bibliographical, theoretical research, with documental survey, which has already started, through analysis of doctrines and periodical articles. Electronic resources are also used for the collection of information, as well as the collection of doctrines on the subject. This is explanatory research, because through this study, the benefits that the application of this new model of shared custody could bring were examined, observing the best interest of the child, observing the mental and physical health of the minor. Concluding about the new custody model, it becomes more difficult in Brazil, due to financial resources for the effective execution of the model in question, lack of family structure and effective dialogues with children.
