Criminal Law And Technology: Crimes Against Honor Commited In A Virtual Environment

This article aims to present crimes against honor committed in a virtual environment. With the technological evolution, the virtual environment has become a tool that encompasses various activities, whether for leisure, work, meetings, research, journalism, among others. The internet has emerged as a need for instant communication at a distance between people. The internet has made it possible to connect people from anywhere on the planet, as well as the instant exchange of messages, audio and videos. Nowadays people spend more time connected to the cell phone screen than doing basic vital activities. The emergence of the internet and its popularization causes a change in social behavior in society, which creates an urgent need to establish rules for users. The basic foundation for using the internet freely is freedom of expression, conformed to the terms of article 2 of Law 12.965 / 14. The crimes committed in the virtual sphere are classified as pure, mixed and common, they are further subdivided into their own crimes and improper crimes. However, criminal conduct in the real world has also migrated to the virtual world, which raises the need for regulation in order to curb cyber crimes. The central theme of the present study is guided by the existing national legislation applied to crimes against honor committed in the virtual environment. However, the computer is used as the main way of committing violations and as access has been expanding these crimes will expand.
