The implications for decriminalization of abortion in Brazil

The present work aims to analyze abortion in relation to religion and the weight that this has on the subject in the legal system and in a secular State. Address the purpose of criminalization and what is really being preserved: life or moral values. Show the consequences of clandestine abortion. To compare the situation of abortion in Brazil and other countries where abortion has been decriminalized. Analyze abortion from the perspective of Human Rights and fundamental guarantees. Clarify that abortion must be decriminalized, taking women out of anonymity and clandestineness, giving them legal and social support, guaranteeing their freedom of choice and their dignity. The methodology used aims to bring reflections on the implications related to the decriminalization of abortion in Brazil, through an exploratory research, since it seeks to provide information on the topic addressed under a perspective free from religious and moral concepts, aiming only to the solution of a controversial and current problem. Through the inductive scientific method and a qualitative-quantitative research, it will discuss legal aspects of the decriminalization of abortion in the Penal Code, Civil Code, legal and religious positions, monographs, electronic addresses and the Federal Constitution.
